Consultation Reponse to Proposed Policy Statement for Part 2 of the Localism Act 2011

The report explained the background to a Government consultation on a proposed Policy Statement regarding the transfer of fines for infringement of EU laws to local authorities under Part 2 of the Localism Act 2011. Consideration was given to a draft response to the consultation which highlighted concerns that authorities should not be liable for fines on matters which did not accord with their duties or responsibilities (for example air quality breaches) and that the regime should apply to new rather than existing laws.
The Cabinet resolved that:
The response to the consultation on Part 2 of the Localism Act 2011, as set out at Annex 1 to the report, be approved.
Reasons: As set out in the joint report of the Director of Health and Housing and Director of Finance.
